The Indonesian archipelago has a diversity of art and culture is very rich. This is in line with the diversity of ethnicity, race, and religion as a whole is a national potential that needs to be protected. The wealth of art and culture is one source of intellectual work that can and should be protected by law. Wealth is not solely to the art and culture itself, but can be used to improve the capabilities in the field of trade and industry that involves the Creator. Thus, the wealth of art and culture that protected it could improve the well-being not only for the Creator, but also to the nation.
Indonesia has participated in the association world community to become members of the Agreement Establishing the World Trade Organization (the Agreement Establishing the World Trade Organization) which include the Agreement on Trade Related Aspects of Intellectual Property Rights (Agreement on Aspects of Trade Intellectual Property Rights), hereinafter called TRIPS, through Law No. 7 of 1994. In addition, Indonesia also ratified the Berne Convention for the Protection of Literary and Artistic Works (the Berne Convention for the Protection of Literary and Artistic Works) through Presidential Decree No. 18 of 1997 and the World Intellectual Property Organization Copyrights Treaty (WIPO Copyright Treaty), hereinafter referred to as WCT, through Presidential Decree No. 19 of 1997.
Currently, Indonesia has had Law No. 6 of 1982 on Copyright as amended by Act No. 7 of 1987 and last amended by Law No. 12 of 1997, hereinafter called the Copyright Act. Although the change was already contained some adjustment clause in accordance with TRIPs, but there are still some things that need to be refined to provide protection for intellectual works in the field of Copyright, including efforts to promote the development of intellectual work that comes from the diversity of art and culture are in above. Of the several conventions in the field of intellectual property rights mentioned above, there are some provisions that have been duly utilized. In addition, we need to affirm and sort position Copyright in one hand and Related Rights on the other hand in order to provide protection for the related intellectual work more clearly.
