Description
THE NATIONAL ASSEMBLY OF THE REPUBLIC OF GUINEA
Under provisions of the Basic Law in Article 59;
Having deliberated, adopted;
PRESIDENT OF THE REPUBLIC promulgates the law which reads as follows: Videos
PRELIMINARY PROVISIONS
Article 1: - The provisions of this Act are the Penal Code.
Article 2: - The applicable penalties are divided into:
- Police Punishment;
- Correctional Penalties;
- Criminal Penalties.
The offense that the Laws punish police punishment is a fine.
The offense that the Laws punished by penalties is a crime.
The offense that the Laws of punishing afflictive or infamous punishment is a crime.
Article 3: - The attempt of an offense is a commencement of execution that
establishes the continued unjust purpose, even if a foreign cause prevent the realization.
The attempt is always punishable for crime.
It is punishable for misdemeanor if an express provision of the Act on
provides.
Article 4: - The penalty for attempt is reduced by one degree for crimes.
In misdemeanor, the maximum penalty is reduced by a quarter.
Article 5: - Unless otherwise expressly provided, no offense may be
sanctioned by law unspoken punishment before it was committed.
The Act is applicable only if it is more favorable to the offender.
Article 6: - In case of conviction of several crimes or offenses, the strongest penalty
only pronounced.
