FIRST BOOK OF OFFENSES AND PUNISHMENT IN GENERAL
SECTION I: GENERAL PROVISIONS
Article 1:
No offense may be punished with the penalties that were brought by the law before the offense was committed.
Article 2:
The offense committed in the territory of the Republic shall be punished according to law.
Article 3:
Any person who, outside the territory of the Democratic Republic of Congo, is guilty of an offense for which the Congolese law provides for a sentence of penal servitude for over two months, can be prosecuted and tried in the Democratic Republic of Congo except application of legal provisions on extradition.
The proceedings may be instituted at the request of the prosecution.
When the offense is committed against an individual and the maximum sentence under Congolese law is five years of imprisonment or more, this request must be preceded by a complaint of the injured party or an official denunciation of authority of the country where the offense was committed.
However, for offenses other than those for Title VIII and the first two sections of Title III of Book II of the Penal Code, no prosecution occurs if the accused proves that he has been tried abroad and finally, if convicted, he suffered his sentence or prescribed or obtained grace.
Except as provided for in Title VIII and the first two sections of Title III of Book II of the Penal Code, the prosecution takes place only if the accused is found in the Democratic Republic of Congo.
