Islamic law and politics are two inseparable sides in an Islamic society. Islamic law without political support is difficult to explore and implement. Politics that ignores Islamic law will cause chaos in society. The better the relationship between Islam and politics the greater the opportunity for Islamic law to be actualized, and the more tenuous the relationship between Islam and politics will be, the less chance that Islamic law will be applied. [1]

The enactment of Islamic law in Indonesia has experienced ups and downs along with the legal politics implemented by state power. Even behind all this, it is rooted in the socio-cultural forces that interact in the process of political decision making. However, Islamic law has developed continuously, both through political infrastructure and political superstructure with the support of social and cultural forces.

Different perspectives and interpretations in the diversity of Muslims' understanding of the nature of Islamic law have implications in their application angle. M. Atho Mudzhar for example explains the different perspectives in the field of Islamic legal thinking according to him divided into four types, namely the books of fiqh, decisions of the religious Courts, legislation in Muslim countries and fatwas of scholars. [2 ]

These four factors are believed to have had a significant influence on the process of transformation of Islamic law in Indonesia. Moreover, Islamic law has actually been in effect since the first arrival of Islam in Indonesia, where the stigma of applicable law is categorized into customary law, Islamic law and Western law. Whereas Islamic law is seen from two aspects. First, Islamic law is valid in formal juridical sense, meaning that it has been codified in the structure of national law. Second, Islamic law which applies normatively, that is Islamic law which is believed to have sanctions or legal equivalents for Muslim communities to implement it.

In the development of law in Indonesia, especially those concerning the development of the application of Islamic law, Islamic law experienced ups and downs following the political direction that existed at that time. What is actually the desire and purpose of the holders of power, both government and political authorities, the application of Islamic law is directed at the policy. During the Dutch administration, for example, there was a theory which was very influential for the Dutch Colonial Government in the formation of law in Indonesia, which was known as reception theory. [3] The influence of this reception theory is still attached to the early days of independence or during the reign of the old order, and even to the reign of the New Order (1967-1998).

During the New Order era, the concept of legal development was directed at the concept of national legal unity, in which religious (Islamic) law adopted by the majority of the Indonesian people could not necessarily be used as applicable law. Some Islamic law to be appointed as legal material requires hard work from Muslims, even though the law is only applied to adherents. Even though Islamic law is the living law that in concept of law should be applied, but by the New Order Government, Islamic law is seen as a religious teaching that does not take root to the earth, because it is sufficiently understood not to be applied. [4]

The position of Islamic law in the legal system in Indonesia which experienced ups and downs was also due to Islamic law was not the only legal system in force at the time, but there were other legal systems, namely customary law and Western law. These three legal systems influence each other in efforts to form a national legal system in Indonesia. This can be seen when approaching independence, the founding fathers differed on the shape and basis of the state and the laws that would apply in Indonesia. [5]
