UNDERSTANDING THE TREASURE UNCLEAN:
What is meant by illegal treasure is any property obtained from the banned Shari'a [1]

Akad CAUSE FACTORS TO BE INVALID AND THE RESULT IS A TREASURE UNCLEAN
There are three factors that lead to an invalid contract so that it becomes forbidden treasure, namely: usury, gharar and zhulm.

Ibnul Qayyim rahimahullah said, "An agreement that does not contain gharar, usury and prohibited shari'ah zhulm impossible [2]"

Ibn Uthaymeen rahimahullah also said, "The cause of Muamalat is forbidden usury, zhulm and gharar" [3].

The following will explain briefly understanding the causal factors muamalat be forbidden.

1. Riba
In language riba means increasing, while according to the term riba is adding burden to the debtor, or add a dose of time to exchange six commodities (namely, gold, silver, wheat, sya'ir, dates and salt) with the same type, or exchange of gold with silver and food with food by not cash.

Riba is divided into
• Dain Riba: Riba whose object is the addition of debt
• Ba'i Riba: Riba whose object is the sale and purchase agreement.

2. Gharar
In language gharar means risk, deception, and flopped or property to the brink of destruction. In terms of buying and selling gharar is unclear end. Most scholars define it by buying and selling between the presence and consequences.

Gharar diharamkam type:
a. Ratio (percentage) gharar in the contract that was great.
If the ratio (percentage) gharar that there is a very big contract then this agreement is forbidden. Al-Baji said, "Gharar in large numbers, that ratio was in the contract is too big so people say that buying and selling is the sale gharar."

b. The existence of a fundamental gharar in the contract.
If the existence of gharar in the contract is the subject of the contract, then the contract becomes unclean. Ibn Qudamah rahimahullah say, "Gharar contained in the contract whose status as followers allowed .... such as: selling goats who are breastfeeding (selling milk in the milk bag animals contain gharar, but allowed for status only as a follower in the transaction), farm animals pregnant (selling the fetus in the belly of its mother contains gharar, but allowed due to its status just as followers in a transaction) ... .. and should not be when sold separately (such as selling cattle fetuses are still in the belly of its mother) "

c. Akad containing gharar that's not including the contract required the crowds.
Allowed to perform the contract containing gharar if the contract takes people a lot, whereas otherwise the contract be unlawful. Imam Nawawi said, "When the contract containing gharar very important, if prohibited would be very troublesome human life, then akadnya allowed".

d. Gharar that occurs in the sale contract.
May perform contract containing gharar if the contract occurred on the grant / probate, whereas for the sale of its legal contract prohibited.

3. zhalim
Zhulm from Arabic which means putting things not in place. In Indonesian usually translated by doing injustice.

According to the terms zhalim means working on the ban and leave the commandment of God. In this sense, any action that goes beyond the provisions of the Shari'a is an act of injustice that is forbidden, either by adding or subtracting.
